GENERAL REGULATIONS
 

ARTICLE 1        CONTROL OF COMPETITION 

1.1     INTERNATIONAL CONTROL

The Federation Internationale de l’Automobile (FIA) is the authority which establishes and governs certain international rules for automobiles, standards for the organization of automobile competitions and specific regulations for World Championship Series of competitions.  FIA has published the International Sporting Code for these purposes. 

1.2      NATIONAL CONTROL 

1.2.1    The Automobile Competition Committee for the United States (ACCUS) is recognized by the FIA as the National Sporting Authority (ASN) for the United States.

1.2.2     ACCUS is therefore the sole authority which oversees international automobile competitions in the USA, its territories and protectorates. 

1.2.3     ACCUS is in turn composed of representatives of its eight member clubs and a number of individuals.  The member clubs of ACCUS are: 

Championship Auto Racing Teams, Inc. (CART)
Grand American Road Racing Association (GRAND-AM)
Indy Racing League (IRL)
National Association for Stock Car Auto Racing, Inc. (NASCAR)
National Hot Rod Association, Inc. (NHRA)
Professional Sports Car Racing, Inc. (SPORTS CAR)
Sports Car Club of America, Inc. (SCCA), and

United States Auto Club, Inc. (USAC)
 

1.2.4     ACCUS delegates to its member clubs most of the normal duties of an ASN, including the authority to organize, sanction and conduct FIA-listed events, and events counting toward International and World Championships. 

1.3        SPORTS CAR CONTROL 

1.3.1     Professional Sports Car Racing, Inc. (SPORTS CAR) has established these rules (the SPORTS CAR Code), which govern the organization and conduct of SPORTS CAR-sanctioned events, the standards for eligibility and conduct of competitors and officials, the regulations for eligibility and preparation of automobiles, and the rules for any annual SPORTS CAR series of events.

1.3.2     The SPORTS CAR Code is in all principles consistent with the International Sporting Code of the FIA; accordingly, it shall take precedence as the governing body of rules for all events sanctioned by SPORTS CAR, whether or not they may be listed on the FIA Calendar. 

1.3.3     All SPORTS CAR members and all SPORTS CAR credential holders are bound by the SPORTS CAR Code and must abide by its provisions. 

1.3.4     SPORTS CAR may amend the SPORTS CAR Code from time to time by publishing a notice of amendment in a SPORTS CAR bulletin mailed to SPORTS CAR competitors, or posted on the SPORTS CAR internet site (www.professionalsportscar.com), and an amendment shall become effective upon the date of such mailing or posting, unless otherwise provided in the notice of amendment. 

1.3.5     Except as provided for in these regulations, other verbal and/or written communication from SPORTS CAR shall not constitute an amendment to the SPORTS CAR Code.  SPORTS CAR may issue an addendum to the SPORTS CAR Code in the same fashion as an amendment providing additional information and/or correcting previous errors and it shall become effective immediately upon publication. 

1.3.6     ACKNOWLEDGEMENT OF RULES

Every Driver, Entrant, Official, Promoter or other participant in a SPORTS CAR-sanctioned event, and every person who is issued a SPORTS CAR credential agrees without reservation to conduct him/herself in accordance with the SPORTS CAR Code.  If there is a disagreement or dispute regarding the meaning or application of the SPORTS CAR Code, the interpretation and application by SPORTS CAR officials shall prevail.  Determinations by SPORTS CAR officials applying or interpreting the SPORTS CAR Code shall be final and non-appealable except as provided in Articles 9 and 10.  In order to promote the sport of auto racing, to achieve prompt finality in competition results, and in consideration of receiving numerous benefits available to them, ALL SPORTS CAR MEMBERS AND CREDENTIAL HOLDERS EXPRESSLY AGREE THAT DETERMINATIONS BY SPORTS CAR OFFICIALS AS TO THE APPLICABILITY AND INTERPRETATION OF THIS CODE ARE NON-LITIGABLE, AND THEY COVENANT THAT THEY WILL NOT INITIATE OR MAINTAIN LITIGATION OF ANY KIND AGAINST SPORTS CAR OR ANYONE ACTING ON BEHALF OF SPORTS CAR, TO REVERSE, OR MODIFY SUCH DETERMINATION OR TO SEEK TO RECOVER DAMAGES OR OTHER RELIEF ALLEGEDLY INCURRED OR REQUIRED AS A RESULT OF SUCH DETERMINATION.  IF A MEMBER OR CREDENTIAL HOLDER INITIATES OR MAINTAINS LITIGATION IN VIOLATION OF THIS COVENANT, THAT MEMBER OR CREDENTIAL HOLDER AGREES TO REIMBURSE SPORTS CAR FOR THE COST OF SUCH LITIGATION, INCLUDING ATTORNEYS’ FEES.
